Terms and Conditions for Commercial Driver Center

Welcome to Commercial Driver Center ("we," "us," or "our"). These Terms and Conditions ("Terms") govern your enrollment in our Commercial Driver’s License (CDL) training programs, use of our website cdcdl.com, and any related services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.
1. Acceptance of Terms
By enrolling in our training programs, accessing our website, or using any of our Services, you agree to these Terms, our Privacy Policy [link to Privacy Policy], and any additional policies or rules we provide. We may update these Terms from time to time by posting the revised version on our website with an updated "Last Updated" date. Your continued use of the Services after such changes constitutes your acceptance of the updated Terms.
2. Eligibility
To enroll in our CDL training programs or use our Services, you must:

Meet all federal and state requirements for CDL training, including but not limited to valid identification, physical fitness, and background check eligibility.

We reserve the right to refuse service to anyone who does not meet these eligibility requirements or for any other lawful reason.
3. Enrollment and Training Programs
a. Enrollment Process

To enroll in a CDL training program, you must complete the registration process, provide all required documentation (e.g., driver’s license, medical certificate), and pay the applicable fees.

Enrollment is subject to availability and our approval. We may deny enrollment if you do not meet eligibility requirements or for other reasons, such as class capacity.
b. Training Program Requirements

You agree to comply with all program rules, instructor directions, and safety protocols during training.

You must attend all scheduled classes, practical training sessions, and assessments unless otherwise approved by us.

Successful completion of the program does not guarantee a CDL license, as licensing is subject to state Department of Motor Vehicles (DMV) or equivalent agency requirements.
c. Background Checks

Enrollment may require background checks, including criminal history and driving record reviews, as mandated by FMCSA regulations or state law.

You consent to such checks and agree to provide accurate information for this purpose.
4. Fees and Payment
a. Tuition and Fees

Tuition and fees for CDL training programs are outlined during the enrollment process or on our website.

All fees must be paid in full before the start of training unless a payment plan is agreed upon in writing.

Additional fees may apply for materials, tests, or rescheduling missed sessions.
b. Payment Terms

Payments may be made by credit card, debit card, or other methods we accept.

You are responsible for ensuring timely payment. Late payments may result in suspension or termination from the program.
c. Refunds and Cancellations

Cancellations by You: If you cancel your enrollment before the program start date, you may be eligible for a partial refund, less a non-refundable administrative fee [specify amount, e.g., $100]. No refunds will be issued after the program begins.

Cancellations by Us: We reserve the right to cancel or reschedule training programs due to insufficient enrollment, instructor availability, or other unforeseen circumstances. In such cases, you will receive a full refund or the option to transfer to another session.

Non-Completion: No refunds will be issued if you fail to complete the program or meet licensing requirements.
5. Your Responsibilities
You agree to:

Provide accurate and complete information during enrollment and throughout the training process.

Comply with all federal, state, and local laws, including FMCSA regulations, during training and testing.

Treat instructors, staff, and other participants with respect and maintain a safe learning environment.

Arrive prepared and on time for all scheduled training sessions.

Maintain any equipment or vehicles provided for training in good condition, subject to normal wear and tear.
6. Intellectual Property
All training materials, course content, logos, and other materials provided by Commercial Driver Center are our property or the property of our licensors and are protected by copyright, trademark, and other intellectual property laws. You may use these materials solely for personal, non-commercial purposes related to your training. You may not reproduce, distribute, or modify these materials without our written permission.
7. Safety and Liability
a. Inherent Risks

CDL training involves operating large vehicles and equipment, which carries inherent risks of injury or property damage. You acknowledge and accept these risks by participating in our programs.

You agree to follow all safety guidelines and instructions provided by our instructors.
b. Limitation of Liability

To the fullest extent permitted by law, Commercial Driver Center, its officers, employees, and affiliates will not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Services, including but not limited to injuries, property damage, or failure to obtain a CDL.

Our total liability for any claim related to the Services will not exceed the amount you paid for the training program.
c. Indemnification

You agree to indemnify and hold harmless Commercial Driver Center and its affiliates from any claims, damages, or losses arising from your misuse of the Services, violation of these Terms, or actions during training that cause harm to others.
8. Termination
We may terminate your enrollment or access to our Services at any time, with or without notice, if you:

Violate these Terms or any program rules.

Engage in unsafe, disruptive, or unlawful behavior.

Fail to make required payments.

Do not meet eligibility or licensing requirements.
Upon termination, you will not be entitled to a refund unless otherwise specified in Section 4(c).
9. Third-Party Services
Our Services may involve interactions with third parties, such as testing facilities, DMVs, or background check providers. We are not responsible for the actions, policies, or services of these third parties. You agree to comply with their requirements and policies.
10. Dispute Resolution
a. Governing Law
